Welcome to SendSlim Clinic (“SendSlim,” “we,” “us,” or “our”). These Terms of Use (“Terms”) describe the rules for using our website located at www.sendslim.com (the “Site”) and any related online tools, forms, content, and services we make available through the Site (together, the “Online Services”).

By using the Site or Online Services, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover use of the website and online tools. Medical care provided by our clinicians (including telehealth visits, prescriptions, labs, and treatment plans) is also governed by other documents such as our Telehealth Consent, Notice of Privacy Practices, and clinic policies you review as part of your patient intake.

1. Who We Are

SendSlim Clinic is a medical weight-loss program operated by Affection Health Care LLC, a healthcare practice based in Modesto, California, United States. Our clinicians may include nurse practitioners, physicians, and other licensed professionals, depending on your state and needs.

We currently provide clinical services only to patients located in states where our clinicians are licensed to practice. We may add or remove states from time to time.

2. Eligibility to Use the Site

To use the Site and Online Services, you must:

  1. Be at least 18 years old;
  2. Use the Site only while in the United States; and
  3. Agree to these Terms and all other policies posted on the Site.

If you become a patient, you must also truthfully complete all intake forms and consent documents. We may refuse or stop providing services if we believe information you provide is false, misleading, or incomplete.

3. Not for Emergencies

SendSlim is not an emergency service.

If you have a medical emergency, call 911 or go to the nearest emergency room immediately.

Do not use the Site, Online Services, messages, or email for urgent or life-threatening issues such as chest pain, trouble breathing, stroke symptoms, or severe allergic reactions.

4. Website Content vs. Medical Care

The general information on the Site (articles, FAQs, videos, blog posts, and other content) is for education only.

  • It is not a diagnosis.
  • It is not a specific treatment plan for you.
  • It does not replace seeing a licensed healthcare professional.

You form a patient–provider relationship with our clinicians only after:

  1. You complete required intake forms and consents;
  2. A SendSlim clinician reviews your information; and
  3. The clinician accepts you as a patient and provides care.

We may decide that our program is not appropriate for you. In that case, we may recommend that you seek care elsewhere.

5. Your Responsibilities

When you use the Site or become a patient, you agree that you will:

  • Provide accurate, current, and complete information about yourself.
  • Use your own name and contact details, not someone else’s.
  • Keep your account login and password safe and private.
  • Tell us if your contact information, medications, allergies, or health conditions change.
  • Use the Site and Online Services only for lawful purposes.

You are responsible for all activity that occurs under your account.

6. Telehealth Services

If you receive clinical services from SendSlim, some or all of your care may be delivered by telehealth (video or phone).

  • Telehealth has benefits and limitations, including possible technical failures.
  • You may be required to sign a separate Telehealth Consent before receiving care.
  • You must be physically located in a state where your SendSlim clinician is licensed at the time of the visit.
  • We may request that you seek in-person care instead of, or in addition to, telehealth.

7. Fees, Payments, and Insurance

Information about fees and pricing is available on the Site and/or in separate program materials.

By using paid services, you agree that:

  • You are responsible for all fees listed for the visits, programs, devices, or subscriptions you choose.
  • Payment is generally due before or at the time of service.
  • Unless clearly stated otherwise, SendSlim operates primarily as a cash-pay clinic and may not bill your insurance directly.
  • Even if we provide you with a superbill or documentation, we cannot guarantee that your insurance will reimburse you.

We may change our pricing and payment policies from time to time. Changes will not apply to services you have already paid for.

8. Prescriptions and Pharmacy Choice

Our clinicians may recommend or prescribe medications only if they believe it is safe and appropriate for you, based on their professional judgment and applicable laws.

You understand and agree that:

  • Not every patient will receive medication, or a particular medication (including GLP-1 medicines or other weight-loss drugs).
  • We do not guarantee that any prescription will be written.
  • We may refuse to prescribe or continue medications if we believe it is unsafe, medically unnecessary, or inconsistent with laws or best practices.
  • You may choose your own pharmacy. We may suggest pharmacies familiar with certain medications or programs, but the final choice is yours unless limited by law or your insurance plan.
  • Medication costs are separate from SendSlim visit fees. We are not responsible for pharmacy pricing or insurance coverage decisions.

9. Privacy and Security

We value the privacy and security of your information.

  • Our use of your health information is governed by our Notice of Privacy Practices and applicable federal and state laws.
  • Our use of non-medical information is described in our Privacy Policy.

By using the Site, you agree that we may collect, use, and share your information as described in those documents.

We use reasonable administrative, technical, and physical safeguards, but no system can be perfectly secure. We cannot promise that our systems will never be breached or that communications over the internet are always secure.

10. Intellectual Property

All content on the Site and Online Services—including text, graphics, logos, icons, images, audio or video clips, and software—is owned by SendSlim, Affection Health Care LLC, our licensors, or our content providers, and is protected by copyright, trademark, and other laws.

You may view content on the Site for your personal, non-commercial use.

You may not, without our prior written permission:

  • Copy, reproduce, modify, distribute, publish, display, perform, create derivative works from, or commercially exploit any part of the Site or Online Services;
  • Use any SendSlim trademarks, logos, or trade dress;
  • Use bots, scrapers, or similar tools to collect data from the Site.

11. User Content and Communications

If you submit information, questions, or feedback through the Site (for example, contact forms, reviews, or comments):

  • You grant SendSlim a non-exclusive, worldwide, royalty-free license to use, copy, modify, and display that content for our business purposes, subject to our Privacy Policy and Notice of Privacy Practices.
  • You promise that your content is accurate and does not violate anyone else’s rights or any laws.

Do not send Protected Health Information (PHI) through ordinary email or social media. Use the patient portal or other secure channels we provide for medical questions whenever possible.

12. Prohibited Uses

You agree that you will not:

  • Use the Site or Online Services for any unlawful purpose or to encourage unlawful activity;
  • Impersonate another person or misrepresent your affiliation with SendSlim or any other entity;
  • Attempt to gain unauthorized access to the Site, user accounts, or our computer systems;
  • Introduce viruses, malware, or harmful code;
  • Attempt to reverse engineer or copy our software or systems;
  • Use the Site in a way that could damage, disable, or overburden our servers or interfere with other users’ use.

We may suspend or terminate your access to the Site and/or services if we believe you have violated these Terms.

13. Third-Party Services and Links

The Site may contain links to third-party websites, apps, or services, including labs, pharmacies, device vendors, or educational sites.

  • These links are provided for your convenience only.
  • We do not control and are not responsible for the content, privacy practices, or services of third parties.
  • Your use of third-party sites is at your own risk and is subject to their own terms and policies.

14. No Warranties

The Site and Online Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent allowed by law, we and our clinicians, employees, contractors, owners, and partners disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Warranties that the Site will be error-free, secure, or always available;
  • Warranties regarding the accuracy or completeness of any information on the Site.

Any reliance you place on information from the Site is at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, in no event will SendSlim, Affection Health Care LLC, or our clinicians, employees, owners, contractors, or affiliates be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;
  • Any loss of data, income, profits, or goodwill;
  • Any damages resulting from (a) your use or inability to use the Site or Online Services, (b) any unauthorized access to or use of our servers, or (c) any interruption or cessation of transmission to or from the Site.

Our total liability for all claims relating to the Site or Online Services will not exceed the amount you paid (if any) for the specific service in question during the three (3) months before the claim arose.

Some states do not allow the exclusion or limitation of certain damages, so part of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless SendSlim, Affection Health Care LLC, our clinicians, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Online Services;
  • Your violation of these Terms; or
  • Your violation of any rights of another person or entity.

17. Changes to the Site and These Terms

We may modify, suspend, or discontinue any part of the Site or Online Services at any time.

We may also change these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and may provide additional notice as required by law.

Your continued use of the Site after changes are posted means you accept the updated Terms.

18. Governing Law and Dispute Resolution

These Terms and any disputes related to the Site or Online Services are governed by the laws of the State of California, without regard to its conflict of law rules.

You agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Stanislaus County, California, and you consent to the personal jurisdiction of those courts.

19. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be interpreted in a way that is consistent with applicable law and reflects the original intent as closely as possible, and the remaining parts will continue in full force and effect.

20. Entire Agreement

These Terms, together with any other policies and consents posted on the Site (such as the Privacy Policy, Notice of Privacy Practices, Telehealth Consent, and Refund & Cancellation Policy), make up the entire agreement between you and SendSlim regarding your use of the Site and Online Services.
